Preparing RCRA LQG 2023 Biennial Reports – We’re Here if You Need Us

Federal regulations require all RCRA hazardous waste Large Quantity Generators (LQGs) to submit a report summarizing the waste they generated and where it went. This “Biennial Report” is due by March 1 of each even-numbered year, and it only covers hazardous waste generated the previous year (2023, this go-round).

You may ask, “How do I know whether this applies to me?” You are a RCRA LQG if your facility:

  • Generated, in one calendar month, greater or equal to 1,000 kg (2,200 lbs.) of non-acute RCRA waste, or
  • Generated, in one calendar month, or accumulated at any time, greater than 1 kg (2.2.lbs) of RCRA acute hazardous waste, or 
  • Generated, in one calendar month, greater than 100 kg (220 lbs.) of any residue or contaminated soil, waste, or other debris resulting from the cleanup of a spill, into or on any land or water, of any RCRA acute hazardous wastes and/or
  • Permitted treatment, storage, recycled, or disposed of RCRA hazardous wastes on-site.
  • Only RCRA hazardous waste counts towards this applicability

The Biennial Report includes the EPA Site Identification (Site ID) form for your site plus one “waste generation and management” (GM) form for generally each waste generated, with certain exclusions and exceptions. 

For California generators, and some other states, Biennial Reports must be submitted through the EPA RCRAinfo system: (https://rcrainfo.epa.gov/rcrainfoprod/action/secured/login). 

Other states may have different requirements for submittal. Whatever your state, reports for 2023 activities are due by March 1, 2024, so it’s high time to start preparing and gathering your hazardous waste information!

We have recently learned that there are new error messages in RCRAinfo Biennial Report. One of which accounts for a weight discrepancy of 10 percent or more and this could be related to the recent change from the CA DTSC: RCRA LQG in CA filing biennial reports must include Non-RCRA and exported hazardous waste, as additional GM forms (Waste Generation and Management Forms). While this was unexpected for us and likely was for you, too, ACTenviro is adapting to the changes in real time and has a working plan that includes direct communication with the DTSC.

  • The reason why CA DTSC is requesting Non-RCRA and exported waste streams 
  • Their leniency with RCRA LQGs generators this year 
  • The impact on states outside of CA.
